By accessing the Site, purchasing a product, or downloading a complimentary/reviewer copy, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.
2) Who We Sell To
You must be at least the age of majority in your state/country to purchase, or have permission from a parent/guardian. We currently sell/ship to: [countries/regions]. We may refuse any order at our discretion.
3) Products & Content
We offer books and related digital content (e.g., ebooks, audiobooks), print editions, and occasional merchandise. We make reasonable efforts to describe items accurately; minor variations (cover, formatting) may occur.
4) Pricing, Taxes, Promotions
Prices are shown in US dollars and may change without notice. Applicable taxes, duties, and shipping are calculated at checkout. Discounts/coupons cannot be combined unless stated. We reserve the right to cancel or adjust mistaken prices.
5) Orders, Payment & Preorders
You authorize us (and our payment processor) to charge your selected payment method. For preorders, your method may be charged at purchase or upon release (per checkout notice). We may limit/cancel quantities per person/household/account if we detect abuse or error.
6) Shipping (Print Only)
We aim to dispatch within 5-7 business days. Estimated delivery windows are not guarantees. Risk of loss passes to you upon carrier’s receipt. If a print item arrives damaged or incorrect, contact us within [7/14] days with photos for a replacement or remedy.
7) Digital Downloads (Ebooks/Audiobooks)
On purchase, you receive a limited, non-transferable, non-exclusive license for personal, non-commercial use. You may not share, upload, resell, or distribute files. We may use watermarks or DRM and may log delivery for anti-piracy. If a file is corrupted, we’ll provide a working replacement.
Refunds on digital items: due to the nature of digital goods, all sales are generally final once the file has been delivered/downloaded, except where required by law.
If we provide an ARC or complimentary copy, it’s strictly for evaluation. You may not redistribute the file. Reviews are never required and, if posted, should disclose that you received a complimentary copy. We may revoke access if misuse is suspected.
9) Returns & Refunds (Print/Merch)
Unused, unopened print items may be returned within [14/30] days of delivery with proof of purchase; you’re responsible for return shipping unless the item was damaged/incorrect. Refunds are processed to the original method once we receive and inspect the return. Digital items are non-returnable (see §7).
10) User Content (Reviews, Comments)
If you post or submit content to us, you grant us a worldwide, royalty-free license to display and share that content in connection with our books and marketing (e.g., reposting a review), subject to any platform policies and your privacy rights.
11) Intellectual Property
All content on the Site and in our products is owned by us or our licensors and protected by IP laws. No rights are transferred to you other than the personal-use license in §7. Trademarks, logos, and series names may not be used without permission.
12) Prohibited Uses
You agree not to: (a) violate laws; (b) infringe IP rights; (c) attempt to bypass security/DRM; (d) scrape the Site; (e) use our content commercially without a license; (f) upload malware or abusive content.
13) Third-Party Services & Links
We may link to retailers or services (e.g., payment processors, distributors). We’re not responsible for third-party content, terms, or policies. Use them at your discretion.
14) Disclaimers
The Site and products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.
15) Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim relating to the Site or products will not exceed the amount you paid to us for the product giving rise to the claim, or $100, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages.
16) Indemnification
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Site/products.
17) Governing Law; Disputes
These Terms are governed by the laws of Utah, USA, without regard to conflict-of-laws rules. Courts located in Utah, USA will have exclusive jurisdiction. (Optional: insert arbitration/mediation clause if you prefer ADR.)
18) Changes to Terms
We may update these Terms at any time. Continued use of the Site after changes indicates acceptance. The “Effective date” will reflect the latest revision.
